Terms and Conditions for Laboratory

Below are the terms and conditions the Laboratory must agree to before enrolling formally to Mero Swaasthya Application (hereinafter referred as the “App”) which is run and operated by INTEGRATED MEDICAL CARE NEPAL PVT. LTD. (hereinafter referred to as the "Developer").

Laboratory shall provide Developer with following documents and credentials to register as Laboratory in App:

  1. Registration Certificate.
  2. PAN Certificate.
  3. Tax Clearance Certificate.
  4. License from the concerned Department.
  5. Laboratory phone number, E-mail and fax number.
  6. Information of first hand contact person to handle complaints.
  7. Name, Phone number, Address and Education Certificate of employees and directors.
  8. List of Tests offered, including test name, code of test, and specimen requirements.
  9. Power of Attorney of authorized person and supporting documents (Minute of Shareholders).

Terms for the Laboratory

  1. Patients shall initiate Service order by filling Service order form and uploading prescription prescribed by the doctors in the App if necessary. Once the service order is placed by the patient it shall be considered as the booked time and service from the Lab.
  2. Service order form of the Patients shall be verified by the Developer and details shall remain with the Developer in first instance. Upon Verification, all the Service ordered by Patients shall be forwarded to the Laboratory along with the prescription and code associated with the Service being ordered.
  3. The Laboratory shall confirm the Service order within an hour upon recipient of Service order by the Laboratory from the Developer or else the Service ordered will be referred to other possible Laboratory and consider as Cancellation of the Service Order.
  4. The Laboratory shall provide quotation along with discounted/undiscounted pricing, Time and contact details of the medical staff or representatives to the Developer within an hour of the Confirmation of the Service Order.
  5. Developer shall forward details as per A (d) to the Patients for the approval.
  6. Upon approval, Developer shall notify of acceptance of the quotation by Patients and shall provide Name, Address and phone number of the Patients.
  7. Laboratory shall perform all tests in compliance with any standard, ruling, or regulation related to Health
  8. Laboratory shall deliver its service as per quotation forwarded, any changes in the quotation, time or Service ordered by any of the parties shall notify first to the Developer before Five hours of confirmed time and any changes at the time of Sample Collection by Laboratory shall be notified to the Developer by both parties and perform Sample Collection after the approval of the Developer.
  9. Laboratory shall be suspended for one week if information as per A (g) is not provided timely to the Developer.
  10. Laboratory shall be responsible for and indemnify Developer and Patients for not rendering the Approved Service Order in time or for providing false report which hampers the patient and the reputation of the Developer. The fine shall be determined as per the time frame noted by the developer for each category of negligence such as for not providing services to the patient, for providing false or wrong report and for hampering the goodwill and reputation of the developer. Other than returning money paid by the patient the fines shall be given to the developer.
  11. Laboratory shall not use the user's (Patient's) personal data like name, contact number, age , sex, medical reports, medical history, email, address , location & others that falls under category of personal information for any marketing, business, reference, research and development purposes without the permission of Developer.

Terms and Conditions for Pharmacy

Below are the terms and conditions the Pharmacy must agree to before enrolling formally to Mero Swaasthya Application (hereinafter referred as the “App”) which is run and operated by INTEGRATED MEDICAL CARE NEPAL PVT. LTD. (hereinafter referred to as the "Developer").

Pharmacy shall provide Developer with following documents and credentials to register as Pharmacy in App:

  1. Company registration document
  2. PAN Certificate
  3. Tax Clearance Certificate
  4. License from the concerned Department.
  5. Pharmacy phone number, E-mail and fax number.
  6. Information of first hand contact person to handle complaints.
  7. Name, Phone number, Address and Education Certificate of employees and directors.
  8. Power of Attorney of authorized person and supporting documents (Minute of Shareholder)

Terms for the Pharmacy

  1. Patients shall initiate Service order by filling Service order form and uploading prescription prescribed by the doctors in the App if necessary. Once the service order is placed by the patient it shall be considered as the booked time and service from the Pharmacy.
  2. Service order form of the Patients shall be verified by the Developer and details shall remain with the Developer in first instance. Upon Verification, all the Service(s) ordered by Patients shall be forwarded to the Pharmacy along with the prescription and details associated with the Service being ordered.
  3. The Pharmacy shall confirm the Service order within an hour upon recipient of Service order by the Pharmacy from the Developer or else the Service order will be referred to another possible Pharmacy and consider as Cancellation of the Service Order.
  4. The Pharmacy shall provide quotation along with discounted/non-discounted pricing via the platform and the Developer shall forward details as per A (d) to the Patients for the approval.
  5. Upon approval, the Developer shall notify the acceptance of the quotation by Patients and shall provide Name, Address and phone number of the Patients.
  6. Pharmacy shall deliver its service as per quotation forwarded, any changes in the quotation, time or Service ordered by any of the parties shall notify first to the Developer on the same day of the Service ordered.
  7. Pharmacy shall be suspended for one week if information as per A (f) is not provided timely to the Developer.
  8. Pharmacy shall be responsible for and indemnify Developer and Patients for not rendering the Approved Service Order in time or for providing expired, damaged, defective or wrong medicine which hampers the patient and the reputation of the Developer. The fine shall be determined as per noted by the developer for each category of negligence such as for:
    1. Providing expired medicine, equipment or item
    2. Providing damaged or torn package of medicine or product
    3. Providing wrong medicine or its wrong dosage quantity, equipment or item that is different from what was requested by the Customer
  9. The Pharmacy shall not deliver or agree to provide any medicine, item or equipment without proper prescription as per the regulations of the Government of Nepal.
  10. The Pharmacy shall only accept the service order if the Pharmacy is able to provide and have all the medicine items, equipment or products delivered as requested by the Customer in such service order. If the Pharmacy fails to provide all the items listed in the Order, this damages the reputation of the Developer, and therefore a fine shall be charged according to the damages caused in such case.
  11. Each medicine item must be wrapped and enveloped singly into each envelope and the envelope must be labeled properly.
  12. The Pharmacy may not use, or encourage, promote, facilitate, or instruct, induce, or otherwise influence or cause others: (1) to use the App or App Services for any activities that violate any law, statute, ordinance or regulation; for any other illegal or fraudulent purpose or any purpose that is harmful to others, or (2) to transmit, store, display, distribute or otherwise make available medicine, item, equipment or package that is illegal, fraudulent or harmful to others.

Terms and Conditions for Ambulance Driver & Delivery Person

Below are the terms and conditions the Ambulance Driver/Delivery Person (hereinafter referred to as the "Driver") must agree to before enrolling formally to Mero Swaasthya Application (hereinafter referred as the “App”) which is run and operated by INTEGRATED MEDICAL CARE NEPAL PVT. LTD. (hereinafter referred to as the "Developer").

Driver shall provide Developer with following documents and credentials to register in App:

  1. Driving license proof
  2. Copy of citizenship

Terms for the Driver

  1. The Driver shall use the Ambulance vehicle strictly following the laws of Nepal.
  2. The Ambulance or delivery vehicle shall not be used for storing or transporting any unlawful item or material or for fraudulent purposes.
  3. The Ambulance or delivery vehicle and the Driver shall not be used to cause nuisance, annoyance or inconvenience to others.
  4. The Driver shall only accept bookings and requests through the App and must not engage in fake bookings.
  5. The Driver shall not attempt to cause any sort of intentional or unintentional harm or damage to the service user.
  6. The Driver must maintain their account credentials confidential and secure.
  7. The Driver shall provide the Developer proof of identity of service users whenever required.
  8. The Driver shall maintain confidentiality of all information of the patient.
  9. The Driver operating Ambulance vehicle shall send quotation to service users with appropriate amount that complies the policies and laws of Nepal related to the ambulance services fare.
  10. Any attempts to misbehave with the service users or make them uncomfortable, unsafe or violated shall not be entertained and may result in the termination of the account of the Driver.
  11. The Developer shall not be responsible for any kinds of accidents caused by the Driver.
  12. The Driver may not use, or encourage, promote, facilitate, or instruct, induce, or otherwise influence or cause others:
    1. to use the App or App Services for any activities that violate any law, statute, ordinance or regulation; for any other illegal or fraudulent purpose or any purpose that is harmful to others, or (2) to transmit, store, display, distribute or otherwise make available item, equipment or package that is illegal, fraudulent or harmful to others.
